The Geographical Reach of International Humanitarian Law in Transnational Armed Conflict

Abstract Non-international armed conflict between States and organised groups is a reality of warfare. Since the emergence 1949 Geneva Conventions, this form has been regulated by international humanitarian law. However, subset category known as ‘transnational conflict’ seen aggressive proliferation over recent decades such Islamic State Iraq Syria have taken advantage internet other technologies to expand their reach beyond national frontiers strike around world. This phenomenon left geographical extent law – which historically relied on boundaries determine its ambit unclear. article examines main options for delimiting regime in transnational conflict. It considers approaches based boundaries; ‘hot battlefields’; ‘global application’ ‘territorial control’ before ultimately concluding that method ‘military presence’ would be most suitable standard.
